These Terms of Service govern your access to and use of Oil Empire – Idle Tycoon, including its software, features, content and related services.

Oil Empire is developed and published by Mikkel Knudsen (“we,” “us” or “our”).

By downloading, installing, accessing or playing Oil Empire, you agree to these Terms. If you do not agree to them, do not download, access or use the Game.

These Terms do not limit any consumer rights that cannot legally be excluded or restricted.

1. Eligibility and younger users

You must be at least 13 years old to use Oil Empire, unless a higher minimum age is required by the laws of your country.

If you are under the legal age of majority where you live, you must have permission from a parent or legal guardian to use the Game and accept these Terms.

A parent or legal guardian is responsible for supervising a minor’s use of the Game and for approving any purchases made by or for that minor.

Additional parental authorization may be required where personal-data processing is based on the consent of a child. More information about the processing of personal data is provided in our Privacy Policy.

Oil Empire is not specifically directed at children under 13.

2. Access to the Game

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use Oil Empire for your own non-commercial entertainment.

You do not acquire ownership of the Game, its software or its content.

Your access may also be subject to the terms and policies of the platform through which you downloaded the Game, including the Apple App Store or Google Play.

You are responsible for:

Using a compatible device and operating system.
Maintaining any internet connection required for particular features.
Keeping your device, platform account and any Oil Empire account or sign-in credentials secure.
Complying with applicable laws and platform rules.

3. Game accounts, progress and save data

Oil Empire may allow you to play as a guest using locally stored progress and may also offer an optional Oil Empire account with account-linked cloud saving.

When you create a new Oil Empire account, the Game may associate the progress currently stored on your device with that account and upload that progress to cloud services.

Available sign-in methods may include email and password or third-party sign-in providers where offered.

When you sign in to an existing Oil Empire account, progress associated with that account may replace the progress currently active on your device. Where the Game presents a warning or confirmation before replacing progress, you are responsible for reviewing that warning before proceeding. Local progress that is replaced and has not otherwise been preserved or associated with another account may become unavailable.

While you are signed in, the Game may synchronize account-linked progress between your device and cloud services. Cloud synchronization depends on internet connectivity, service availability and successful completion of synchronization and may not occur instantly or continuously.

When you log out of an Oil Empire account, account-owned local progress on that device may be cleared and the Game may return to a fresh guest state. Progress that was successfully synchronized with the account may be available again when you sign back into the same account, subject to compatibility and service availability.

We do not guarantee that save data will transfer between different devices, operating systems, installations or platform accounts unless the Game specifically supports such transfers.

Deleting the Game, clearing application data, resetting or losing a device, or otherwise removing locally stored data may result in the loss of guest progress or progress that was not successfully synchronized.

You are responsible for maintaining the security of your account credentials and for activity occurring through your account where caused by your failure to keep those credentials secure.

Account deletion is intended to be permanent. If you delete an Oil Empire account, you may lose access to progress and features associated with that account. The processing, retention and deletion of personal data associated with accounts is described in the Privacy Policy and is subject to applicable law.

We take reasonable measures to protect and operate local and cloud save systems correctly, but we cannot guarantee that save data will never be lost, corrupted, delayed, unavailable or affected by technical failures, synchronization errors or service interruptions.

Contact us if you experience a significant issue involving account access, lost progress or purchased content. Nothing in this section limits any remedy available to you under applicable consumer law.

4. Virtual currency, items and rewards

Oil Empire may include virtual currency, oil, gold, boosts, bundles, upgrades, spins, rewards and other digital items or benefits collectively referred to as “Virtual Goods.”

Virtual Goods:

Are licensed for use only within Oil Empire.
Have no real-world monetary value.
Cannot be redeemed for cash or other property.
Cannot be sold, traded or transferred outside the Game.
Do not represent money, stored value or ownership of property.
May only be used for the purposes made available within the Game.

You may receive Virtual Goods through gameplay, advertisements, achievements, promotions or purchases.

Unless required by law, you may not sell, exchange, transfer or attempt to commercially exploit Virtual Goods or Game progress.

Purchased virtual currency will not expire solely because time has passed. However, access may be affected if the Game is lawfully discontinued, a purchase is refunded, or access is restricted because of fraud or a serious violation of these Terms.

5. In-game purchases

Oil Empire may offer optional purchases of Virtual Goods, bundles or premium content.

Purchases are processed by the platform through which the Game was downloaded, such as Apple or Google. We do not directly receive or store your complete payment-card details when a purchase is processed by those platforms.

Before completing a purchase, you are responsible for reviewing:

The product description.
The displayed price and currency.
The contents of the purchase.
Whether the item is consumable or restorable.
Any applicable platform terms.

Some bundles or products may be limited to one purchase per player or platform account. Any such restriction will be displayed in the Game or product description.

A completed purchase may result in the relevant Virtual Goods or content being added to your Game or platform entitlement.

Where supported, restorable non-consumable purchases can be restored through the applicable platform’s purchase-restoration functionality.

6. Refunds and payment disputes

Refund eligibility is determined by applicable law and the policies of the platform that processed the purchase.

For purchases made through the Apple App Store, refund requests should normally be submitted through Apple.

For purchases made through Google Play, refund requests should normally be submitted through Google Play or, where directed by Google, to us.

Nothing in these Terms removes or limits any right you may have to a refund, replacement, repair, price reduction, cancellation or other remedy under applicable consumer law.

If a purchase is refunded, reversed or cancelled, we may remove the corresponding Virtual Goods, currency, content or entitlement from the Game where technically possible.

You must not knowingly:

Make fraudulent purchases.
Use payment methods without authorization.
Claim a purchase was unauthorized when you knowingly made or approved it.
Repeatedly request refunds for content that has already been consumed as part of an abusive scheme.
Attempt to retain both refunded funds and the corresponding purchased content.

Legitimate complaints, refund requests and payment disputes made in good faith will not by themselves be treated as misconduct.

7. Advertisements and promotional rewards

Oil Empire may display optional or mandatory advertisements supplied by third-party advertising providers.

Some advertisements may offer an in-game reward in exchange for watching or completing the advertisement. A reward is only granted when the Game receives confirmation that the applicable requirements have been completed.

An advertisement may occasionally fail to load or complete because of:

Internet connectivity.
Device settings.
Advertising-provider availability.
Regional restrictions.
Consent settings.
Technical errors.

We do not guarantee that a particular advertisement or advertising reward will always be available.

Information about advertising providers and related personal-data processing is provided in the Privacy Policy.

8. Gameplay changes and balancing

Oil Empire is an evolving game. We may make reasonable changes to its gameplay, economy and presentation, including changes to:

Upgrade costs.
Production rates.
Reward amounts.
Reward probabilities.
Research effects.
Timers and cooldowns.
Unlock requirements.
Advertisements.
User-interface elements.
Technical requirements.
Available features or content.

These changes may be made to improve balance, correct errors, prevent abuse, maintain compatibility, comply with law or platform requirements, or continue development of the Game.

We will not intentionally remove a paid entitlement without a legitimate reason. Where a material change adversely affects paid digital content, any mandatory rights and remedies available under applicable consumer law remain unaffected.

Updates may be required to continue using the Game or particular features.

9. Acceptable use

You must not:

Use cheats, bots, macros, external automation tools, modified clients or unauthorized third-party software.
Exploit bugs, errors or unintended gameplay mechanics to obtain an unfair advantage.
Circumvent purchase systems, advertisements, timers, progression systems or technical restrictions.
Modify, decompile, reverse-engineer or attempt to derive the Game’s source code, except where such activity is expressly permitted by applicable law.
Access or interfere with Game systems, servers or data without authorization.
Distribute malicious code through or in connection with the Game.
Use the Game for unlawful, fraudulent or commercial purposes.
Copy, sell, rent, sublicense, redistribute or commercially exploit the Game or its content.
Falsely represent an affiliation with Oil Empire or its developer.
Infringe intellectual-property, privacy or other legal rights.

If you discover a bug or vulnerability, please report it to us rather than exploiting or publicly distributing it in a way that could harm the Game or its users.

10. Enforcement

If we reasonably believe that you have seriously or repeatedly violated these Terms, we may take proportionate action where technically possible.

Such action may include:

Correcting improperly obtained progress or Virtual Goods.
Removing Virtual Goods obtained through fraud or exploitation.
Restricting access to online or promotional features.
Refusing support for modified or unauthorized versions of the Game.
Suspending or permanently restricting access to services controlled by us.
Reporting unlawful conduct to the applicable platform or authorities.

Where appropriate, the seriousness, frequency and circumstances of the violation will be considered.

Nothing in this section affects mandatory rights relating to legitimately purchased digital content.

11. Intellectual property

Oil Empire and the Game’s original software, artwork, interface, text, designs, characters, branding, audiovisual elements and other original content are owned by or licensed to Mikkel Knudsen.

Third-party software, fonts, music, sound effects, plugins, development tools, platform services and other licensed materials remain the property of their respective owners and may be subject to separate licence terms.

Except for the limited licence granted under these Terms, you may not copy, reproduce, modify, distribute, publicly display, sell, license or create derivative works from Game content without prior written permission or another lawful basis.

The name “Oil Empire,” together with its associated logos and branding, may not be used in a way that falsely suggests sponsorship, endorsement or affiliation.

12. Feedback

You may voluntarily submit suggestions, ideas, bug reports or other feedback concerning Oil Empire.

You retain ownership of any intellectual property you already hold in your feedback. However, by submitting feedback, you grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free and sublicensable licence to use, reproduce, adapt and incorporate that feedback into the Game or other products without compensation or attribution.

Do not submit confidential information through feedback channels.

13. Third-party platforms and services

Oil Empire may depend on or interact with third-party services, including:

Apple.
Google services, including Firebase services used for authentication, cloud saving and backend functionality.
Unity services.
Advertising providers.
Analytics providers.
Crash-reporting providers.
Social-media or community platforms.

Those services are controlled by their respective providers and may be governed by separate terms and privacy policies.

We are not responsible for the independent actions, availability or policies of third-party services. However, this does not exclude responsibility that cannot legally be excluded.

Apple, Google and other platform providers are not responsible for providing customer support for Oil Empire unless their own policies state otherwise.

14. Privacy

Our Privacy Policy explains how personal data may be collected, used, shared, stored and protected in connection with Oil Empire.

The Privacy Policy also explains your applicable privacy rights and how to exercise them.

The Privacy Policy forms part of your use of the Game but does not reduce any rights provided by applicable data-protection law.

15. Availability and discontinuation

We aim to keep Oil Empire available and functional, but we cannot guarantee uninterrupted or error-free access.

The Game or particular features may be temporarily unavailable because of maintenance, updates, technical failures, security issues, platform decisions or circumstances outside our reasonable control.

We may modify, suspend or discontinue the Game or individual features where reasonably necessary.

Where practical, we will provide reasonable notice before permanently discontinuing a significant paid service or feature. Any mandatory consumer rights relating to purchased digital content remain unaffected.

16. Disclaimer of warranties

To the maximum extent permitted by applicable law, Oil Empire is provided on an “as is” and “as available” basis.

We do not guarantee that:

The Game will always be uninterrupted or error-free.
Every device will remain compatible.
Every feature will always remain available.
All defects can be corrected immediately.
Local or cloud save data will never be lost, corrupted, delayed or unavailable.
The Game will meet every user’s expectations.

Nothing in these Terms excludes any statutory guarantee, warranty, conformity requirement or other consumer protection that cannot legally be excluded.

17. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when you accepted these Terms.

We are not responsible for loss caused by:

Your violation of these Terms.
Unauthorized modifications to the Game.
Unsupported devices or operating systems.
Loss of access to your Apple, Google or other third-party account.
Third-party services outside our reasonable control.
Deleting the Game, clearing locally stored Game data, deleting an account, or loss of data caused by failed or incomplete synchronization with account or cloud services, except where we are legally responsible.

Nothing in these Terms excludes or limits liability for:

Fraud or fraudulent misrepresentation.
Intentional misconduct or gross negligence where it cannot be excluded.
Death or personal injury caused by negligence where applicable.
Mandatory consumer rights.
Any other liability that cannot legally be excluded or limited.

18. Changes to these Terms

We may update these Terms when reasonably necessary to reflect:

Changes to the Game.
Changes to our business or services.
Legal or regulatory requirements.
Security concerns.
Platform requirements.
New features or payment methods.

The updated Terms will include a revised “Last Updated” date.

Where required by law, we will provide notice of material changes before they take effect. Continued use of the Game after the effective date of updated Terms constitutes acceptance where permitted by law.

Changes will not retroactively remove rights that you have already obtained under applicable law.

19. Governing law and disputes

These Terms are governed by the laws of Denmark, without regard to conflict-of-law principles.

If you are a consumer living outside Denmark, this choice of law does not remove any mandatory consumer protection granted to you by the laws of the country in which you normally live.

Before beginning formal proceedings, you are encouraged to contact us so that we can attempt to resolve the issue.

Nothing in these Terms prevents you from:

Bringing a claim before a court with jurisdiction under applicable law.
Using an applicable consumer complaint or alternative dispute-resolution body.
Exercising any mandatory right available in your country.

These Terms do not require consumers to submit disputes exclusively to private arbitration.

20. Severability

If a court or competent authority finds any provision of these Terms invalid, unlawful or unenforceable, that provision will be applied to the maximum extent legally permitted or removed where necessary.

The remaining provisions will continue in effect.

21. No waiver

If we do not immediately enforce a provision of these Terms, that does not mean that the provision has been waived.

Any waiver must be clear and applies only to the specific circumstances for which it was given.

22. Entire agreement

These Terms, together with the Privacy Policy and any mandatory platform terms, form the agreement governing your use of Oil Empire.

If a platform’s mandatory terms conflict with these Terms regarding billing, downloads, refunds or platform services, the mandatory platform terms will apply to those matters.
